Before using any KA ANGLER product, please read the safety information on this page and ensure that all equipment is appropriately selected, matched, inspected and used for the actual fishing conditions.

General Mandatory Pre-Use Statement

Before operating any KA ANGLER fishing product, you must fully read this entire safety notice, all printed product warnings, user instructions and specification limits. All equipment shall be selected, matched, inspected and operated in strict accordance with actual fishing environments and rated product performance limits.

1. Intended Use & Legal Compliance

All KA ANGLER fishing gear is manufactured solely for lawful non-commercial recreational and sport fishing activities within Australia. All users must comply with:

The printed rated load, weight and performance specifications marked on each product;
All attached safety warning labels, user guides and operational restrictions;
State and federal fisheries regulations, marine safety laws, environmental protection rules and local waterway bylaws;
Mandatory site-specific safety requirements at all boat ramps, rock platforms, beaches, jetties and freshwater locations.

Unless explicitly approved in writing by KA ANGLER or clearly printed on product packaging, this equipment must never be utilized for:

Commercial fishing, aquaculture or industrial harvesting operations;
Marine rescue, emergency flotation or life-support systems;
Personal lifesaving, buoyancy aid or protective safety gear replacement;
Lifting human beings, transporting heavy cargo, winching loads or any non-fishing industrial application.

Important Legal Statement: Fishing tackle does not satisfy Australian Standard AS flotation/lifesaving requirements. It cannot substitute for certified AS-approved lifejackets, marine VHF radios, EPIRBs, distress lighting or first-aid kits required under Australian maritime safety law.

2. Suitable Equipment Selection & Risk Assessment

Target fish species, fishing techniques, waterway type, tide, swell, wind and weather directly determine safe equipment specifications. Users shall select gear based on:

3. Pre-Use Inspection & Ongoing Product Maintenance

Conduct a full visual and functional inspection of all tackle before every single fishing trip, including verification of:

Rod blank for cracks, splits, permanent deformation, corrosion or abnormal abrasion;
Line guides, reel seats, foam grips, fasteners and connecting joints for looseness, rust or structural failure;

After every fishing session, clean saltwater residue, fully air-dry all metal and composite components, apply anti-corrosion maintenance treatments and store gear per user guide instructions. Improper cleaning, inadequate corrosion protection, incorrect storage or continued use of damaged tackle may cause sudden product failure, serious lacerations, impalement injuries or property loss.

4. Water & Outdoor Inherent Safety Risks

All forms of Australian fishing carry inherent obvious recreational risks under the Civil Liability Act 2002 (WA), including but not limited to:

Slipping, tripping or falling from uneven rock ledges, jetties, unstable shorelines or vessel decks;
Unplanned water entry leading to submersion, drowning or cold-water shock;
Unpredictable rapid changes in tide height, offshore swell, rip currents, wind gusts and severe weather events;
Structural failure of public jetties, rock platforms, rental vessels or public marine infrastructure;
Sharp tackle cuts, hook impalement, lure puncture injuries from flying line or broken components;
Injury, laceration or poisoning from wild fish, stingrays, marine creatures and coastal wildlife;
Permanent disability, catastrophic bodily harm or fatality arising from combined environmental and tackle hazards.

Mandatory Pre-Trip Obligations:

Check official Bureau of Meteorology marine weather warnings, tide charts and coastal hazard alerts before all fishing trips;
Fully comply with all state/federal fisheries, marine safety and environmental legislation;
Carry and wear an AS-standard approved lifejacket where legally required or risk-appropriate;

5. Safe Tackle Handling & High-Risk Hazard Warnings

Confirm a fully clear casting zone free of pedestrians, vessels, overhead trees, powerlines and stationary obstacles before every cast;

6. User Statutory Responsibilities

Fishing and marine outdoor activities contain non-eliminable inherent risks under Western Australian civil liability law. All users must evaluate personal health, physical capacity, fishing skill, forecast weather, sea state and location hazards to independently judge if an activity is safely practicable.

Legally binding user obligations include:

Selecting gear matching your target fishing environment and load requirements;
Full compliance with correct assembly, operation, post-use cleaning and corrosion maintenance procedures;
Completing mandatory pre-use equipment inspection before every trip;
Strict adherence to all printed product safety warnings and operational limits;
Full compliance with all federal, state and local marine/fisheries statutes;
Carrying and utilising all AS-standard personal protective and lifesaving equipment required by law.

Critical Legal Note: No fishing equipment can replace mandatory independent risk assessment, proper trip preparation and statutory marine safety precautions required by Australian law. KA ANGLER retains a concurrent duty to provide clear, legible safety warnings for all supplied tackle. If insufficient or misleading safety disclosures create foreseeable injury hazards, KA ANGLER cannot rely on this section to exclude liability.

7. Product Performance Disclaimer

Actual field performance of all fishing tackle is impacted by multiple external uncontrolled variables:

Waterway type, weather, swell, wind speed and water current strength;
Target fish species, average and maximum fish fighting weight;
Combination matching of rod, reel, line, hooks and lure weight;
Individual casting technique, angler skill and experience level;
Standard of post-session cleaning, anti-corrosion maintenance and storage;
Natural wear arising from prolonged regular field use over time.

KA ANGLER makes no guarantee that use of any product will result in fish capture, nor that any single tackle model is universally suitable for all species, waterways, sea states or angling techniques nationwide.

All product photography, demonstration footage, laboratory load testing data and customer angler testimonials solely illustrate performance under specific controlled testing conditions. Real-world results will reasonably differ based on environment, tackle setup and user operating method. This statement does not exclude statutory consumer guarantees for acceptable quality and fitness for purpose under the ACL.

8. Modification & Third-Party Repair Policy

Users must not fully disassemble, structurally modify or conduct self-repair on KA ANGLER products without prior written authorisation from KA ANGLER or its network of authorised service providers.

Limited Voluntary Warranty Exclusions

The KA ANGLER 12-month Limited Manufacturer Warranty (a voluntary benefit supplementary to ACL statutory rights) will not cover damage or safety defects caused by:

Unauthorised full disassembly, structural modification or third-party unapproved repair;
Incorrect component assembly, mismatched non-OEM replacement parts;
Permanent structural alterations changing factory-designed load performance limits;
Repairs completed by technicians outside KA ANGLER’s official authorised service network.

Critical ACL Distinction

Exclusions to our voluntary limited warranty do not remove your statutory consumer guarantee rights under the Australian Consumer Law. Even where gear has been modified by the user, you retain full legal remedies if the product contains a manufacturing safety defect that creates serious foreseeable harm.

When replacing line, leaders, hooks, split rings or lures, verify all replacement component specifications match the printed load and weight limits of your core fishing equipment and target fishing environment.

9. Limitation of Liability

Statutory Non-Excludable Liability

Nothing within this Safety Information and Liability Notice excludes, restricts or modifies KA ANGLER’s full legal liability for:

Death or serious personal injury caused by our negligence, defective manufacturing, missing safety warnings or breach of ACL consumer guarantees;
Loss or damage arising from safety defects in products supplied by KA ANGLER under Australian product liability law;
Any statutory remedy, compensation claim or consumer guarantee right that cannot lawfully be contracted out of under the Competition and Consumer Act 2010 (Cth) or Australian Consumer Law.

Permitted Liability Limitations

KA ANGLER shall not be liable for indirect, consequential or economic loss, minor property damage or personal harm arising solely and directly from:

Operating products outside their printed intended use, maximum load rating or lure weight limits;
Failure to follow printed safety warnings, user instructions, marine/fisheries legislation or mandatory pre-use inspection requirements;
Continued repeated use of visibly cracked, corroded, damaged or structurally faulty tackle after defects are identified;
Failure to carry, wear or deploy legally required AS-standard lifesaving, communication and safety equipment;
Voluntary user negligence, reckless unsafe fishing conduct or foreseeable misuse of tackle;
Unauthorized disassembly, structural modification or third-party unapproved repair;
Improper transport, inadequate saltwater cleaning, insufficient anti-corrosion maintenance or incorrect long-term storage;
Extreme natural weather events, unforeseen rapid tide/swell shifts, rips, storms and other environmental hazards entirely outside KA ANGLER’s reasonable operational control;
Independent acts or omissions of third-party individuals, retailers, marine facility operators or other external parties unrelated to KA ANGLER’s product supply.

10. Australian Consumer Law Mandatory Statutory Statement

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Under ACL statutory consumer guarantees, all KA ANGLER fishing products must meet the standard of acceptable quality, which includes being fit for ordinary recreational fishing purposes, possessing reasonable finish and appearance, free from latent manufacturing defects, structurally safe and durable under rated operating limits.

Remedy Entitlements Breakdown

Major Failure: If a product suffers a major failure to meet consumer guarantees, consumers hold the legal right to select either a full purchase price refund or a brand-new product replacement, plus compensation for all reasonably foreseeable consequential loss or injury.
Non-Major Failure: For defects not classified as a major failure, consumers are legally entitled to free product repair or replacement within a reasonable commercial timeframe, plus any additional statutory remedy permitted under federal consumer legislation.

KA ANGLER’s voluntary 30-day change-of-mind return scheme and 12-month Limited Manufacturer Warranty are complimentary extra customer benefits and operate separately from non-derogable ACL statutory protections. These voluntary policies never replace, restrict or reduce your permanent statutory consumer rights under Australian law.

11. Mandatory Product Safety Incident Reporting Obligation

If KA ANGLER becomes aware of any death, serious bodily injury or illness that may have been caused by the use or foreseeable misuse of our fishing tackle, we are legally required to submit a formal written incident notification to the Australian Competition and Consumer Commission (ACCC) within 2 full business days of gaining knowledge of the incident.
